Microsoft Rescinded a Job Offer After Background Check | ArticlesBase.com

In the 2009 issue of New Jersey eAuthority, there was news published regarding the Schley v. Microsoft Corp. case. Apparently Microsoft revoked its written job offer to a candidate after failing the background check. According to the story, the plaintiff was sent a letter by Microsoft telling him that he’s being offered a job for the company. It did however, mention in the letter, that the offer only is effective if he’s cleared after the background check. He probably missed that part through all the excitement, because he ended up, not only without a job, but without a home as well. It seems that he went to talk to the hiring manager who, maybe simply trying to be friendly, suggested he quit his job, sell his house, and transfer from New Jersey to Washington, to be prepared for the position, which he instantly did so. But he later then was told he failed the admission for the job after being found out that he had a felony conviction record.

This incident is a grave example not only of what jumping into conclusions could do, but what a criminal background check result could cause. Although the story might have sounded so negative because of the deprivation of work for the said plaintiff, it should be remembered that the letter was at some pointed drafted to mean well. It even included the conditions about the offered work. Almost every establishment around the state, especially the large ones, requires not only a criminal background check for its employees and applicants, but a comprehensive background search all in all. These background checks cover everything from previous employment history, to significant license and credit records, and many more. These prerequisites are necessary in order for the company to be able to evaluate an applicant or employee’s capacity, attitude, assets, and behavior.

In most cases, the incident above could have gone a different route had at some point the plaintiff disclosed the felony conviction prior to the job offer. This information could prove to be helpful in finding ways to contradict a company’s withdrawal because if they had known about it before, say during an interview or something, they wouldn’t have the reason to be shocked after the conviction appeared during the background check. However, if the said information wasn’t disclosed, then the applicant really is at fault. Basically because he should’ve known the effects of a felony charge being in an individual’s background. This type of information is a terrible case sensitive issue that should immediately be relayed to the hiring committee so as to be cleared whether it would influence your application’s process. When you’ve done all these, at least you’re guaranteed that when they do request a background check from you, they already know at some point what to expect from it. And that the information you shared to them, after they had heard it, wouldn’t bother them nor go in the way of your application anymore. If and only if, they’d still consider the process after you’ve told them about the condition of your background record.

Around 220 games are available on UMD format along with the latest movies on the same format (although I hear they may be phasing out the UMD movies).The PSP uses the Magic Gate memory sticks, on which you can store and play MP4 movies,T.V. shows, video’s etc and MP3’s, you can also surf the internet using the integrated wireless technology!

This is the lower priced of the handheld Video Game Systems.The DS does not have all the bells and whistles of the PSP but what it does have is a pair of 3-inch screens.One of the two screens is a touchscreen which Nintendo have built their games around. The DS is a great reasonably priced Video Game System and has some cool games for kids and grown ups alike (I particularly like the Brain Training series of games). There are nearly 300 games for the Nintendo DS, and it can also play the old Game Boy Advance games.

Cyber-Bullying Goes Federal & MySpace Fakery Could Be a Crime

In a highly unusual use of a federal law in which legal experts describe as “creative” and “aggressive,” a St. Louis, Missouri woman has been indicted in what may be the country’s first case of cyber-bullying. Federal prosecutors say Lori Drew, 49, and others created an account on the social networking site MySpace pretending to be a 16-year-old boy to fool her neighbor, 13-year-old Megan Meier.

According to prosecutors, Drew used the MySpace account to establish a relationship with Meier, acting for weeks to be a boy interested in forming a romantic relationship her. A short time later, Drew suddenly ended the relationship, taunting Meier and telling her the world would be better off without her. Consequently, a distraught Meier committed suicide by hanging herself.

Drew is Arrested and Charged with a Crime

The federal indictment, which was delivered in Los Angeles after state prosecutors in Missouri declined to bring charges, is unprecedented, and legal commentators believe it may seriously stretch the federal statute on which it was based. The indictment charged that in violation of MySpace terms of service, “Drew and co-conspirators knowingly and agreed with each other to intentionally access a computer … to further a tortious act, namely, intentional infliction of emotion distress.” According to the prosecution, Drew violated MySpace’s terms by using a fictitious name, among other things, and thus had no authority to access the MySpace service.

“This adult woman allegedly used the Internet to target a young teenage girl, with horrendous ramifications,” said United States Attorney Thomas O’Brien. “Any adult who uses the Internet or a social-gathering website to harass or bully another person, particularly a young girl, must realize their actions can have serious consequences.”

The Unprecedented Charges may Create a New Realm of Cases

The case presents a new wrinkle in the interpretation of federal law. Legal experts warned that such an interpretation could criminalize routine behavior on the internet. After all, people regularly create accounts or post information under aliases for many legitimate reasons, including avoiding spam and a desire to maintain their privacy online.

This new interpretation also gives a business contract the force of a law: violations of a web site’s terms of service could now lead to criminal sanctions, instead of just civil lawsuits or ejection from a site.

“I think the danger of applying a statute in this way is that it could have unintended consequences,” said John Palfrey, a Harvard law professor. “An application of a general statute like this might result in chilling a great deal of online speech and other freedom.” Drew is scheduled to be arraigned in St. Louis but the trial will be held in Los Angeles were MySpace is headquartered. If convicted of the charges, Drew faces up to 20 years in prison.

Cyberstalking is a recent form of criminal behavior involving persistent threats or unwanted attention using the Internet and other means of computer communications.

With more and more people going “online,” the opportunity to target someone on the Internet is becoming limitless. Cyberstalkers visit chat rooms, discussion forums or message boards in search of victims. The range of cyberstalking can range from aggressive and hostile email, chat room bullying, leaving abusing messages in guest books to sending e-viruses, tracing a victim’s computer and identity theft.

Like regular stalkers, cyberstalkers want to intimidate and control their victims. Cyberstalkers do it with the use of the Internet. The Internet can be used to trace the victim’s real name and address. For instance, it is remarkably easy to find out what party a victim is planning to attend and when by checking the information on a site such as Facebook.

The use of technology makes locating a victim easier than ever before. Anyone can type in certain key words into the computer which will bring up a myriad of internet datafurnishing companies that supply private records and information online, either free or for a nominal fee. The internet can do what private detectives of the past only dreamed of doing.

States are attempting to deal with this new form of criminal behavior. Early in 2009, the state of California enacted a set of new stalking laws. These laws make it a misdemeanor to publish information on the Internet which describes a teacher or his or her family or mentions where the teacher lives with the intent of having another person commit a crime against that teacher. The penalty is up to one year in prison and/or a $1,000 fine. This law can also be invoked to protect people other than teachers against cyber-threats. It is now considered a misdemeanor in California to place any person in fear of his or her safety by means of Internet threats and threats using cell phones, PDAs, video recorders or pagers.

Several cases of cyberstalking have been prosecuted under California’s new cyberstalking laws. In the state’s very first case, the state prosecuted a man who used the internet to impersonate his victim, a young woman who’d spurned his attentions. Pretending to be the victim, the man posted her phone number and address and stated that she had rape fantasies she wanted fulfilled. Strange men started to show up at the victim’s apartment ready to rape her and became angry when she refused. The cyberstalker was sentenced to six years in prison.

In another case, a graduate student from the University of San Diego cyberstalked five female students for a year. He sent hundreds of threatening emails. The graduate student was arrested and sentenced to six years in prison. He told police the women were ridiculing him. The victims, in fact, had never met this man.

Prior to California’s anti-cyberstalking laws, the crime was difficult to prosecute. Deidre Des Jardins, a student at UC-Santa Cruz, started getting violet emails from her ex-boyfriend. Some threats were directed at her, others dealt with violence in general. Local law enforcement agents were unable to do anything since the act of cyberstalking had not been clearly defined as a crime. The campus police, also, were unable to act, even though the threatening emails continued for several years. Deidre was told that since some of the messages dealt with violence in general and not specifically with her, it didn’t fit the definition of cyberstalking. Her ex-boyfriend was never arrested.

Cyberstalking can evolve into real-life stalking where the victim is harassed by excessive telephone calls, vandalism, trespassing and even physical assault.

Some cyberstalkers know their victims. Others have some kind of imaginary connection to the ones they stalk. It is not unusual for a celebrity cyberstalker to become violent when his fantasy is threatened. In a recent news story, a cyberstalker sent cyberthreats to a Knox County state’s attorney because the stalker believed that the state’s attorney was interfering in his relationship with model Cheryl Tiegs. The cyberstalker was obsessed with Tiegs and had been stalking her for years. She had never met him. The relationship existed in the cyberstalker’s mind only.

Cyberstalking is a real threat. Due to limited laws, the only real defense to use caution when revealing personal information on the Internet. The less, the better.

In the book, from which NBC News has obtained excerpts, Palin writes: “That day in sunny Texas, when the divorce rumors were rampant in the tabloids, I watched Todd, tanned and shirtless, take the baby from my arms and walk him back to the ranch house so Trig could nap while I made calls. Seeing Todd’s blue eyes smiling, I chuckled. ‘Dang,’ I thought. ‘Divorce Todd? Have you seen Todd?’”
Palin, 45, publicly addressed the divorce rumors this past summer, after Alaska political blog The Immoral Minority posted an August 1 story about an alleged marital breakdown that immediately hit the mainstream media.
